Update of the EU Packaging Waste Regulations

The EU has issued a new regulation (EU) 2025/40 on packaging waste, repealing 94/62/EC. The transition period for the regulation lasts until August 12, 2026. The new regulation adds requirements for PFAS in food contact packaging materials. Overall requirements are as follows:
The total amount of lead, cadmium, mercury and hexavalent chromium shall not exceed 100 mg/kg.
For PFAS in food contact packaging, the following requirements must be met:
a. Each PFAS shall not exceed 25 ppb (excluding polymers)
b. The total amount of PFAS shall not exceed 250 ppb (excluding polymers).
c. The total amount of PFAS (including polymer PFAS) calculated as fluorine shall not exceed 50 ppm. If the fluorine content exceeds 50 ppm, the manufacturer, importer or downstream user shall provide a certificate of fluorine content, specifying the exact content as PFAS or non-PFAS, to facilitate the preparation of the technical documentation required in Annex V of this regulation.
